French Court Rules that Installation of “Smart” Meters is Not Mandatory in European Law

Great news from France!  Thanks to Claire Edwards for this translation.

The Court of Appeal of Bordeaux, France, has confirmed that the installation of a “smart” meter is not mandatory. The court has stated that,

Contrary to what is claimed by Enedis [a French electricity company], no legal or regulatory text, European or national, requires Enedis, a private commercial company, public service concession-holder, to install smart meters at the homes of individuals“.

This confirmation benefits all consumers, even non-victims of microwaves.

The court also recognized an unlawful function added to the “smart” meter by Enedis which, according to the former director of the “smart” meter programme, enabled surveillance of the starting or stopping of certain appliances in the home, such as a dishwasher.

The court ruled as follows: “This function, described as “intrusive” by Enedis’ opposing parties, is confirmed by the publication of the university thesis carried out under a contract with the Research and Development Department of Smart Meters, which states that “The characteristics of the electrical consumption of a device in the short moment after it is turned on can be used to identify the device”. “[…] It must therefore be held that Enedis failed to fulfil its obligation to provide information as defined by the provisions of Article L. 111-1 of the Consumer Code.”

So here we have the elements of rights that we have talked so much about. Accordingly: no penalty on refusal to allow the installation of a “smart” meter.

Fees for manual readings of meters will be slightly increased to about € 30 per year, instead of about € 21 usually.

No charge can be made for installation because it is already included in the ENEDIS contract for the maintenance of the network, and it is even less justified if you refused the “smart” meter.

  1. My Tenant in Fontenay le Comte vendee has just had a lnky put in against my wishes . She said that the installer said it is obligatoire.
    Help , please .

    1. She will likely have to file a Notice of Liability against the installer as quickly as possible. Once she has made it clear that she does not consent, if they put it on anyway, they are liable. Please go to this website for more information: http://InPowerMovement.com
